Chain of custody (digital): the term explained

A digital chain of custody is the documented, unbroken record of how a piece of digital evidence was captured, received, fingerprinted, sealed and handled from that moment on, supporting the traceability of the material and its handling rather than the truth of the events the material shows.

What does chain of custody mean for digital files?

The term began with physical evidence. A bagged item moves from the scene to the property room to the lab, and every handover is signed, dated and logged, so nobody can argue the item was swapped between two points. Break one link and the exhibit weakens.

The digital version asks the same questions about a file. How did it reach us, has it changed since, and who touched the case afterwards?

A photograph emailed by a customer carries almost none of that. You cannot tell from the attachment whether it was recorded that morning or three years ago, whether it was edited before sending, or whether the copy in your case folder today is the copy that arrived. That is not an accusation. It means the file holds no evidence about itself, so every later question becomes a matter of recollection.

How a digital chain of custody works

A workable chain usually has six links, each covering the gap the previous one leaves open.

  • Capture. Material recorded inside a guided flow rather than selected from a gallery. That shortens the record, save, edit, export, upload path down to open, follow the instruction, record, submit.
  • Receipt. A server-side arrival time, set by the receiving system rather than the participant's device.
  • Fingerprint. A SHA-256 hash computed on each file as it arrives, pinning the exact content to a value anyone can recompute later.
  • Seal. A signed manifest binding the files, the answers and the session record into one submission that can be verified as a whole.
  • Case history. Every meaningful action after arrival: reviewed, assigned, status changed, retake requested, further material received, closed.
  • Verification. The ability to recheck the fingerprints and the seal months later, ideally with a key that works outside the original system.

Chain of custody example: the disputed lease return

A leased van is returned in April and charged for a damaged rear panel. In December the fleet customer disputes the charge and says the panel was photographed as sound at handover. A chain of custody lets the leasing company show the handover capture, its receipt time, and that the file being reviewed is byte for byte the file received in April.

It does not settle who caused the damage. It settles which images were actually in front of the person who raised the charge, and when.

What the chain does not prove

  • It does not date the incident. Receipt time tells you when the system took delivery of a submission. Damage may have occurred weeks earlier.
  • It does not authenticate the scene. Every link can be intact while the recording shows a staged or misleading situation.
  • It does not identify the person. A device signal or a GPS location reading is context about the session, not proof of who held the phone.

Saying this plainly is worth more than overclaiming. An assessor who knows exactly what the chain covers will use it correctly under challenge. One who was told it proves authenticity gets caught out the first time the other side asks a precise question.

Where digital chains break

Most breaks are procedural rather than cryptographic.

  • Re-encoding. Someone downloads the video, compresses it for a report, and the working copy no longer matches the recorded fingerprint.
  • Copies without provenance. A file forwarded to a third party arrives detached from its receipt record and its seal.
  • Gaps in the case history. Actions taken by phone or email, outside the system, leave holes nobody can fill a year later.
  • Retention that expires mid-dispute. A purge rule set for data protection reasons deletes the original before the file closes.

The fix for the first three is to keep the original untouched and work from derived copies. The fix for the last is to align retention with your real dispute window rather than a default setting.

When does a digital chain of custody matter?

It matters when a decision is questioned long after it was made: a disputed motor claim, a warranty rejection, a lease-return charge, a contractor arguing about the state of a site on the day they left. Cases outlive the people who handled them. Handlers move on, contractors leave, teams reorganise, and customers remember events differently in good faith. A documented chain preserves what was actually available to the organisation at the time it decided.
